The Bombay High Court on Wednesday adjourned the hearing of Aryan Khan, the son of Bollywood superstar Shah Rukh Khan, in the case of the Mumbai drugs seizure for a second time, following a similar decision the day before.
The bail applications of Aryan Khan, Arbaaz Merchantt, and Munmum Dhamecha are currently being heard by a single-judge bench of Justice Nitin W Sambre of the Bombay High Court. The hearing on their bail applications will resume at 2.30 p.m. on Thursday in the courtroom.
In a related development, the Bombay High Court will be closed from November 1 to November 12, for the Diwali holiday. In addition, due to the fact that November 13 and 14 are Saturday and Sunday, the court will be closed on those days. On Thursday and Friday, if Aryan Khan does not receive bail, he will be forced to remain in jail until November 15.
Aryan Khan, 23, was taken into custody on October 3 during a raid by the Narcotics Control Bureau (NCB) on the Cordelia Cruises’ Empress ship off the coast of Mumbai. He was arrested with several others. His bail application had previously been denied by both the magistrate court and the special NDPS court, according to court records.
According to Arbaaz Merchantt’s lawyer, Amit Desai, during today’s hearing in the high court, the arrests of his clients Aryan, Arbaaz, and Munmum were unconstitutional. “We [Aryan and Arbaaz] can be subjected to stringent conditions, but we cannot be imprisoned for more than a year for a crime for which the punishment is only one year. The former Attorney General Mukul Rohatgi, who appeared on behalf of Aryan Khan, continued, “The law requires that you provide true and correct grounds for your arrest.”
Amit Desai asserted that there was no connection between the WhatsApp conversations and the investigation. “There is no connection between the two. There will be no WhatsApp messages or phone calls between the accused “He raised his voice in protest.
“If the remand is examined, it becomes clear that there is no connection between the two. We [Aryan, Arbaaz, and Munmum] are being held in jail for WhatsApp conversations while they do this.”
Further, Desai stated that the WhatsApp conversations cited by NCB’s lawyers are “very old” and have no connection to the incident.
